The Mandatory Provident Fund Schemes Authority (MPFA) today (October 13) obtained two orders for payment of outstanding MPF contributions at around $280,000 against two employers in the District Court. The MPFA also pursued eight claims in the Small Claims Tribunal for some $120,000 on behalf of 18 employees, who were owed MPF contributions by their employers.
The District Court today issued two judgements against two employers, Tang Ka Po trading as Kin Kee and Ho Hau Chung trading as Serene Trading Co. The defendants were ordered to pay the MPFA the sums of $175,213.23 and $107,255.98, being mandatory contributions in arrears and surcharges payable to 10 and three employees of the defendants respectively.
At the Tribunal's hearing today, Ho Man Chi trading as Mountain Special Steel Company, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA the sum of $39,206.74, being mandatory contributions in arrears and surcharge payable.
The other seven defendants - All Clad Asia Limited, Pizzaiolo Limited trading as Solstice, Poly Success Engineering Limited, Topmond Food Limited, Bright Charter (Hong Kong) Limited trading as Tung Lok Hin, Power Fair Limited trading as Kam Kee Bakery and Lick Sang Rice Limited - did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $44,376.18, $21,422.89, $8,275.6, $5,323.14, $3,668, $1,081.37 and $724, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for each District Court case and $240, $160, $490, $230, $200, $310, $280 and $170 as the costs in respect of the claims.
