Nine employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (May 26) obtained an order for payment of outstanding MPF contributions owed to 22 employees at around $170,000 against one employer in the District Court.  MPFA today also pursued eight claims in the Small Claims Tribunal for some $250,000 on behalf of 14 employees, who were owed MPF contributions by their employers.

     The District Court today issued a judgement against one employer, Teletech Communication Limited. The defendant was ordered to pay the MPFA the sum of $173,825.58, being mandatory contributions in arrears and surcharges payable to 22 employees of the defendant.

     At the tribunal's hearing today, three defendants - Kayart Bus Limited, Grand Supreme Limited and Superior Removal & Transportation Limited - did not dispute the amounts claimed.ĦĦThe Adjudicator ordered them to pay the MPFA the sums of $38,320.58, $33,495 and $20,300.44 respectively, being mandatory contributions in arrears and surcharges payable.

     The other five defendants - Tung Nam Transportation Limited, Choi Nam Choi trading as Shun Cheong Construction Civil Engineering, Yiu Wai Engineering Company Limited, Karlford Industrial Limited trading as Siu Sin Nursing Centre and Lucky Link Investment Limited trading as Sun Wah Restaurant (translation) - did not appear in the hearing.  In their absence, the Adjudicator ordered them to pay the MPFA the sums of  $45,361, $41,005.12, $38,312.53, $31,967.44 and $6,450, being mandatory contributions in arrears and surcharge payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the tribunal respectively further awarded payment of $930 for the District Court case and $260, $170, $240, $260, $170, $300, $290 and $360 for the Tribunal cases as costs in respect of the claims.

     Superior Removal & Transportation Limited and Karlford Industrial Limited trading as Siu Sin Nursing Centre pleaded guilty at Kwun Tong Magistracy earlier to 12 counts and 17 counts of failing to make MPF contributions on time and were fined $30,000 and $20,600 respectively.
