Employer fined for breaching MPFS Ordinance

    An employer was fined  $10,200 at the Kwun Tong Magistracy today (February 7), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485) (the "Ordinance").

     For the case of Wong Ka Kee trading as C & K Engineering Co which committed the offences under section 7A(8) of the Ordinance, the defendant pleaded guilty to five counts of failing to make MPF contributions within the prescribed time for the contribution periods of January, and between March and June, 2005.  The defendant was fined $5,000 for the first summons and $1,300 each for the other four summonses, totalling $10,200.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today pursued one claim in the Small Claims Tribunal for some $1,000 on behalf of one employee, who was owed MPF contributions by his employer.

     The defendant, Liu Chi Wah trading as Lorry Catering Service, did not appear at today's hearing.  In its absence, the Adjudicator ordered it to pay the MPFA the sum of $1,445.85, being mandatory contributions in arrears and surcharge payable.

     The amount awarded will be reimbursed to the employee's MPF account as soon as it is received by the MPFA.  The court further awarded payment of $130 as the cost of the claim.
