Employer fined for wage offences and default of Labour Tribunal awards

     Nice Smart (Hong Kong) Limited was earlier convicted at Kwun Tong Magistrates' Courts for wage offences and default of the sums awarded by the Labour Tribunal (LT) under the Employment Ordinance (EO). The employer was also ordered by the court to clear the outstanding LT awarded sums of about $165,000 to the two employees concerned. The employer was fined $60,000 at Kwun Tong Magistrates' Courts on January 27. The prosecution was launched by the Labour Department (LD).

     The employer failed to pay wages within seven days after terminating the employment of its employees, as required by the EO. Also, the employer failed to pay employees the LT awarded sums within 14 days after the payment dates specified in the awards.

     "The judgment would disseminate a strong message to all employers that they have to pay wages to employees in accordance with the EO and the awarded sums according to the terms of the awards issued by the LT," a spokesman for the LD said.

     "The LD will not tolerate these offences and will spare no effort in enforcing the law and safeguarding employees' statutory rights," the spokesman added.
