Company directors held personally liable for breaching MPFS Ordinance

    Two company directors and three employers were fined $76,900 at the Kwun Tong Magistrates' Courts today (April 3), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485) (the "Ordinance").

     The defendants, Cheung Kwok Fai and Chan Wai Chun, directors of China Concept Trading Limited (BR no.: 30506864) responsible for the company's administration, were charged with offences under section 7A(8) and section 44 of the Ordinance. The defendants pleaded guilty to six counts respectively of failing to make MPF contributions for their employees within the prescribed time for the contribution periods from July to August 2004. The defendants were fined $7,000 for the first summons and $2,000 each for the other five summonses, totalling $17,000 respectively.

     For the case of Genesis Engineering Company Limited (BR no.: 304505832), which was charged with offences under section 7A(8) of the Ordinance, the defendant pleaded guilty to three counts of failing to make MPF contributions within the prescribed time from August and October 2005. The defendant was fined $8,000 for the first summons and $3,000 each for the other two summonses, totalling $14,000.

     For the case of First Rate Logistics Limited (BR no.: 20162503), which was charged with offences under section 7A(8) of the Ordinance, the defendant pleaded guilty to six counts of failing to make MPF contributions within the prescribed time from May to October 2005. The defendant was fined $8,000 for the first summons and $2,000 each for the other five summonses, totalling $18,000.

     For the case of King Harvest Asia Limited (BR no.: 33273149), which was charged with offences under section 7A(8) of the Ordinance, the defendant pleaded guilty to four counts of failing to make MPF contributions within the prescribed time from March to June 2004. The defendant was fined $6,000 for the first summons and $1,500 each for the other three summonses, and was ordered to pay $400 in court costs, totalling $10,900.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today pursued one claim in the Small Claims Tribunal for some $29,000 on behalf of one employee, who was owed MPF contributions by the employer.

     The defendant, Tak Fu Vehicle Repairs Limited, did not appear at the hearing. In its absence, the Adjudicator ordered it to pay the MPFA the sum of $29,885, being mandatory contributions in arrears and surcharges payable.

     The amount awarded will be reimbursed to the employee's MPF account as soon as it is received by the MPFA. The court further awarded payment of $260 as the cost of the claim.
