Company and its director fined for default of Labour Tribunal awarded payment

     Sun Tac Laboratory Furniture Engineering Limited and its director were convicted at Kwun Tong Magistrates' Courts on June 30 for failing to pay statutory holiday pay and annual leave pay and defaulting on awarded payment of the Labour Tribunal under the Employment Ordinance. The company and its director were also ordered by the court to clear the outstanding Labour Tribunal awarded sums of about $120,000 to the employee concerned. The company and its director were then fined $53,000 and $35,000 respectively at Kwun Tong Magistrates' Courts today (July 7).

     The company failed to pay the statutory holiday pay as required by the Ordinance and the amount involved was about $5,100. Also, the company failed to pay the annual leave pay within seven days after the termination of employment. The amount involved was about $12,000. Furthermore, the company failed to pay the awarded sums of about $120,000 to the employee within 14 days after the specified payment date of the Labour Tribunal award.

     The director was also convicted for his consent, connivance or neglect in the default on payment of the Labour Tribunal award.

     "The judgment would disseminate a strong message to all employers, directors, managers, secretaries and other similar officers of companies that they have to pay the statutory entitlements to employees in accordance with the Employment Ordinance and the awarded sums according to the terms of the award issued by the Labour Tribunal or the Minor Employment Claims Adjudication Board," a spokesman for the Labour Department said.

     "The Labour Department will not tolerate these offences and will spare no effort in enforcing the law and safeguarding employees' statutory rights," the spokesman added.
