An employer fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     An employer was fined $5,000 at the Kwun Tong Magistracy today (November 10), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance (the Ordinance).

     Yu Oi Man trading as Kin Nai Engineering was charged with an offence under section 7(1A)(a) of the Ordinance. The defendant pleaded guilty to one count of failing to ensure that his employee continued to be a member of a registered scheme throughout employment and was fined $5,000.

     Separately, the Mandatory Provident Fund Schemes Authority (MPFA) today obtained 3 orders for payment of outstanding MPF contributions of about $371,000 against 3 employers at the District Court.

     The 3 employers were China (International) Water Proofing Limited, Wing Wai Transportation Company Limited and Ka Wai Food Company Limited. They were ordered to pay the MPFA $170,501.3, $140,297.32 and $60,277.82 respectively, being mandatory contributions in arrears and surcharges payable to 8, 6 and 6 employees of the respective defendants.

     The amounts awarded at the District Court will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered each defendant to pay the costs of $930.
