Employer fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     An employer was fined $8,000 at the Kwun Tong Magistracy today (March 8), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Hong Kong Wah Kiu (Overseas) Services Limited was charged for an offence under section 7(1) of the Ordinance. The defendant was fined $8,000 for the summons for failing to enroll its employee in an MPF scheme as required by the Ordinance.

     Moreover, the MPFA today pursued six claims in the Small Claims Tribunal for some $91,000 on behalf of 16 employees, who were owed MPF contributions by their employers.

     At the Tribunal's hearing today, the six defendants, namely Grand Shine (H.K.) Limited trading as Tequila Mexican Restaurant & Bar, Sinocom Industries Ltd, Genufx Systems Limited, Laifu Jewellery (Hong Kong) Co., Limited, Chan Chi Fung, and Blue Sky Enterprise Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $43,210.34, $20,992.91, $15,925, $5,639.97, $4,564.05 and $708.75, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The Tribunal further ordered the respective defendants to pay $200, $236, $99, $145, $80 and $113 as the costs in respect of the claims.
