Nine employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (May 21) obtained an order in the District Court against an employer for payment of outstanding MPF contributions at about $178,000. The MPFA pursued eight claims in the Small Claims Tribunal for about $174,000 on behalf of 23 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgment against Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant. The defendant was ordered to pay the MPFA $178,759.40, being mandatory contributions in arrears and surcharges payable to 76 employees of the defendant.

     At the tribunal's hearing, defendants Hang kee Construction & Engineering Company Limited and Chan Yim Ching, Irene & Fong Chi Keung trading as Eastwest Printing & Industries Co, did not dispute the amount claimed. The Adjudicator ordered them to pay the MPFA $12,452.43 and $9,540, being mandatory contributions in arrears and surcharges payable.

     The other six defendants, Wong Yat Tung trading as Tung Sing Glass Co, Cheng Kwok Cheung trading as Jetone Engineering Company, Massgood Investment Limited trading as Masswell Parking Equipment & Consultant Company, Tosi Mau Hung, Kong Kwok On & Fong Chun Hing trading as Wing Lun Construction Engineering Co, Start Plan Investment Limited trading as Aberdeen Kam Moon Lau Restaurant and Kruse Electronic Components (Hong Kong) Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $43,318.80, $42,785.15, $42,000, $19,960.64, $3,899.17 and $377.50, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendant to pay costs of $930. The tribunal ordered the respective defendants to pay costs of $186, $180, $209, $194, $200, $199, $119 and $125.
