General Security Limited was fined $16,000 at Tsuen Wan Magistrates' Court today (April 6) for violation of the Occupational Safety and Health Ordinance. The prosecution was launched by the Labour Department.
The case involved a fatal accident that occurred in Tung Chung on May 19 last year, in which an electric meter reader is suspected to have fallen into a lift shaft while carrying out his duties.
According to Section 7(1)(a) of the Occupational Safety and Health Ordinance, the occupier of the premises where the workplace of an employee was located and the premises were not under the control of the employer of the employee, must ensure that the premises were, so far as was reasonably practicable, safe and without risks to health. Any occupier who fails to do so is liable to a fine of $ 200,000.
According to Sections 6(1), 6(2)(a) and 6(2)(c) of the Occupational Safety and Health Ordinance, the employer shall provide and maintain a system of work and provide information, training and supervision as necessary to ensure, so far as reasonably practicable, the safety and health of the workers employed. Any employer who fails to do so is liable to a fine of $200,000.
