Nine employers ordered to pay MPF arrears

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (May 13) pursued nine claims in the Small Claims Tribunal for some $136,000 on behalf of 17 employees, who were owed MPF contributions by their employers.

     At the Tribunal's hearing today, two defendants, Long Ki Logistics Limited and Hung Yuk Mo formerly trading as Chiu Fung Noodle Restaurant, did not dispute the amount claimed. The Adjudicator ordered them to pay the MPFA the sums of $11,636.14 and $10,890, being mandatory contributions in arrears and surcharges payable.

     The other seven defendants, namely Hing Wong HK China Freight Limited, Chan Wai & Chen Binghong & Yang Haner trading as Sun Hoi Tin Restaurant, Waheungai Company Limited, 100 Flavor Restaurant (Management) Company Limited, Li Ping Chung trading as Honour Motors Co, Honour Investment (Hong Kong) Limited and Chiu Hon Wah, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $37,105.96, $26,630, $21,992.41, $15,064.11, $8,747.21, $2,570.76 and $1,885 respectively, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The Tribunal further ordered the respective defendants to pay $80, $209, $206, $159, $149, $173, $109, $79 and $40 as the costs in respect of the claims.

     Waheungai Company Limited had pleaded guilty previously at Kwun Tong Magistracy to five counts of failing to make MPF contributions on time and was fined $12,000.
