Eight employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (5 June) obtained an order in the District Court against an employer for payment of outstanding MPF contributions at about $175,000. The MPFA also pursued seven claims in the Small Claims Tribunal for about $142,000 on behalf of 19 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgment against Legendfield Limited trading as Wong Shing Seafood Hot Pot Restaurant. The defendant was ordered to pay the MPFA $175,875.40, being mandatory contributions in arrears and surcharges payable to 46 employees of the defendant.

     At the tribunal's hearing today, Peng Yuan Bo and Peng Hai Yun trading as Luen Wo Ginseng Company and Chan Choi Hing formerly trading as Ka Wing Knitting Factory, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $31,280 and $9,135, being mandatory contributions in arrears and surcharges payable.

     The other five defendants, Glorytex trading Limited, Jet Win Logistics Limited, Pang Chak Cheung trading as Wing Cheung Transportation Company, Business & Industrial Trade Fairs Limited and Ha Young Enterprises Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $47,192.50, $38,983.21, $11,943.75, $4,200 and $276.90, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees¡¯ MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendant to pay costs of $930. The tribunal ordered the respective defendants to pay costs $140, $120, $176, $170, $129, $106 and $76.
