Two proprietors fined for violating safety rules

     Woo Hing Holding Limited and Cheung Pak Lin Engineering were fined $38,000 and $30,000 respectively at Kowloon City Magistrates' Courts today (June 5) for violation of the Factories and Industrial Undertakings Ordinance. The prosecutions were launched by the Labour Department.

     The case involved a fatal accident on May 4 last year at a construction site in Kowloon Tong.  A worker was crushed to death by a collapsing wall which was being demolished.

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor must provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risks to the health of the person employed.  Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.

     In addition, Regulation 7(b) of the Factories and Industrial Undertakings (Protection of Eyes) Regulations, the proprietor must take all reasonable steps to ensure that every person who is provided with eye protective equipment makes full and proper use of it.  Any proprietor who fails to do so is liable to a fine of $50,000.
