Three employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (January 18) obtained an order in the District Court for payment of outstanding MPF contributions at about $290,000 against an employer. The MPFA also pursued two claims in the Small Claims Tribunal for some $40,000 on behalf of five employees, who were owed MPF contributions by their employers.

     The District Court today issued a judgment against  Hui Kwong On trading as Nam Wah Tung Kong Restaurant. The defendant was ordered to pay the MPFA the sum of $291,447,4, being mandatory contributions in arrears and surcharges payable to five employees of the defendant respectively.

     At the tribunal's hearing today, Armed Forces Security (HK) Limited, did not dispute the amount claimed.  The Adjudicator ordered it to pay the MPFA the sum of $8,357.96, being mandatory contributions in arrears and surcharges payable.

     The other defendant, Chun Sing Transportation Limited, did not appear. In its absence, the Adjudicator ordered it to pay the MPFA the sum of $34,158.54, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for District Court case and $80 and $260 as the costs in respect of the Tribunal's claims.

     Armed Forces Security (HK) Limited pleaded guilty at Kwun Tong Magistracy earlier to eight counts of failing to make MPF contributions on time and was fined $14,400.
