The Mandatory Provident Fund Schemes Authority (MPFA) today (June 28) pursued 13 claims in the Small Claims Tribunal for some $350,000 on behalf of 36 employees, who were owed MPF contributions by their employers.
At today's hearing, the defendant, Brainson Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA the sums of $4,471, being mandatory contributions in arrears and surcharges payable.
The defendants, Nuclear Construction and Engineering Company Limited, Fore Leader Limited trading as Luxuriant Seafood Restaurant, Southern Fortune Trading (Hong Kong) Limited, Tsoi Mau Hung and Fong Chun Hing trading as Wing Lun Construction Co, Tsoi Mau Hung, Kong Kwok On and Fong Chun Hing trading as Wing Lun Construction Engineering Co, Fung Chung Lok trading as Studio Paragon International, Glory Top Construction Engineering Limited, Ng Ming Sing, Ko King Sam trading as Yat Yik Stationery Company, JP Technology Limited, Wing Ko Food Limited, Pacific Long Distance Telephone Corporation Limited and U. Care International Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $47,920.02, $47,138.09, $46,228.34, $45,278.36, $35,891.76, $35,750.40, $31,555.60, $20,301.17, $16,222.44, $8,041.77, $5,825.76 and $997.50, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The court further awarded payments of $230, $160, $320, $170, $190, $210, $170, $130, $200, $210, $90, $220 and $170 as the costs in respect of the claims.
Pacific Long Distance Telephone Corporation Limited pleaded guilty at Kwun Tong Magistrates' Court earlier to four counts of failing to make MPF contributions on time and was fined $8,500.
