Nine employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (May 29) obtained three orders in the District Court for payment of outstanding MPF contributions against three employers.  MPFA today also pursued six claims in the Small Claims Tribunal for some $120,000 on behalf of 11 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgements against three employers - Pei Cargo Services Co Ltd, Seventh Corporation Limited and Cheung Wing Kit trading as Wing Hing Cargo Service Co. The defendants were ordered to pay the MPFA the sums of $496,975.98, $496,000 and $435,112.1 respectively, being mandatory contributions in arrears and surcharges payable to 22, 84 and 9 employees of the defendant respectively.

     At the Tribunal's hearing today, two defendants, Kayart Bus Limited and Hin Sum Manpower Company Limited, did not dispute the amounts claimed.ĦĦThe Adjudicator ordered them to pay the MPFA the sums of $44,257.36 and  $10,546.72 respectively, being mandatory contributions in arrears and surcharges payable.

     The other four defendants - Karlford Industrial Limited trading as Siu Sin Nursing Centre, Agel Hong Kong Limited, Ng Siu Sing trading as Advance Bowling Technology Workshop and  Look-In Construction Engineering Company Limited - did not appear at the hearing.  In their absence, the Adjudicator ordered them to pay the MPFA the sums of $43,691.39, $16,743.7, $13,771.54 and $750.76, being mandatory contributions in arrears and surcharge payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payment of $930 for the second and third District Court cases and $160, $80, $180, $300, $150 and  $210 for the Tribunal cases as costs in respect of the claims.

     Karlford Industrial Limited trading as Siu Sin Nursing Centre and Hin Sum Manpower Company Limited pleaded guilty at Kwun Tong Magistracy earlier to 17 counts and 6 counts of failing to make MPF contributions on time and were fined $20,600 and $21,000 respectively.
