Five employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (April 28) obtained three orders for payment of outstanding MPF contributions owed to 36 employees at around $1,510,000 against three employers in the District Court. MPFA today also pursued two claims in the Small Claims Tribunal for some $47,000 on behalf of five employees, who were owed MPF contributions by their employers.

     The District Court today issued judgments against three employers, namely, Orient Garment Limited, Li Siu Man formerly trading as Luen Bon Engineering Co. and Leung Sum, Choy Chi Yan and Leung Wing Sze Wincy all trading as Sam's Corporation. The defendants were ordered to pay the MPFA the sums of $843,074.66, $619,730.32 and $54,718.84 respectively, being mandatory contributions in arrears and surcharges payable to 18, 16 and two employees of the defendants respectively.

     At the Tribunal's hearing today, the two defendants, Cheung Tim Cheung trading as Tsui Fu Hin Restaurant and Court Jonathan William trading as Linbeck & Rausch (HK) Lighting Consultants, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $32,256 and $15,573.74 respectively, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for each of the three District Court cases and $205 and $180 for the Tribunal cases respectively as costs in respect of the claims.
