Nine employers ordered to pay MPF non-payments

    The Mandatory Provident Fund Schemes Authority (MPFA) today (March 20) pursued nine claims in the Small Claims Tribunal for some $290,000 on behalf of 17 employees, who were owed MPF contributions by their employers.

     At today's hearing, the seven defendants - Hui Wai Fong trading as Union Enterprises Company; Genesis Engineering Transportation Company Limited; Nam Tai Security company Limited; Poon Kim Tung, Tang Ngan Cheung, Cheung Yat San, Yue Suk Han trading as Ming Tai Watches Metal MFY; Seventh Corporation Limited; Magnate Holdings Limited trading as Toro Janpanese Restaurant; and Brighter Cleaning Service Co - did not dispute the amounts claimed.

     The Adjudicator ordered them to pay the MPFA the sums of $46,501.9, $46,187.7, $45,143.2, $35,327.3, $30,917.56, $11,895.19 and $11,782.92 respectively, being mandatory contributions in arrears and surcharges payable.

     The other two defendants, Shun Hing Container Co Ltd and Prosper Finishing Limited, did not appear at today's hearing.  In their absence, the Adjudicator ordered them to pay the MPFA the sums of $40,101.58 and $22,911.22, being mandatory contribution in arrears and surcharge payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA.  The court further awarded payments of $230, $170, $160, $290, $130, $200, $140, $370 and $300 as the costs in respect of the claims.

     Seventh Corporation Limited and Nam Tai Security Company Limited pleaded guilty at Kwun Tong Magistracy earlier to 16 counts and four counts of failing to make MPF contributions on time and were fined $44,000 and $14,000 respectively.
