Employer fined for breaching MPFS Ordinance

    An employer was fined $5,000 at the Kwun Tong Magistracy today (January 10), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Lau Muk Wah trading as Lung Kong Transp Co. (BR no.: 21171616) committed an offence under section 7 of the ordinance. The defendant was fined $5,000 for failing to enrol its employee in an MPF scheme as required by the ordinance.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today pursued two claims in the Small Claims Tribunal for some $48,000 on behalf of two employees, who were owed MPF contributions by their employers.

     At today's hearing, the defendant, Euro-Asia Surveyors Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA the sum of $6,871.02, being mandatory contributions in arrears and surcharges payable.

     Another defendant, United Fame Enterprise Limited trading as Lucky Restaurant, did not appear at today's hearing. In its absence, the Adjudicator ordered it to pay the MPFA the sum of $41,501.60, being mandatory contributions in arrears and surcharges payable.

     The amount awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The court further awarded payment of $160 as costs in respect of both claims.

     Also, the District Court today issued a judgment against an employer. The defendant, United Fame Enterprise Limited trading as Lucky Restaurant, was ordered to pay the MPFA the sum of $104,792.38, being mandatory contributions in arrears and surcharges payable to three employees of the defendant.

     The amount awarded will be reimbursed to the employees' MPF accounts as soon as it is received by the MPFA. The court further ordered the defendant to pay $930 to the MPFA as the cost of the claim.
