Employer fined for breaching MPFS Ordinance

    An employer was fined $5,000 at the Kwun Tong Magistracy today (January 5), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance (Cap. 485) (the "Ordinance").

     For the case of Great Vision Technology Limited (BR no.: 31685205) which has committed an offence under section 7A(8) of the Ordinance, the defendant was convicted of one count of failing to make MPF contributions within the prescribed manner for the contribution period of January 2005.  The defendant was fined $5,000.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today pursued six claims in the Small Claims Tribunal for some $120,000 on behalf of 10 employees, who were owed MPF contributions by their employers.

     At today's hearing, the defendant, Well Union & Union Limited, did not dispute the amount claimed.  The Adjudicator ordered it to pay the MPFA the sum of $27,007.45, being mandatory contributions in arrears and surcharges payable.

     Another five defendants, including Sun Brain (Hong Kong) Limited, King Size Fashion Shop Company Limited, Look-in Construction Engineering Company Limited, Yeung Ka Lai trading as Yat Sing Travel Company, and Shair Lin Chow trading as Tat Shing Motor Electrical Air Condition Engineering, did not appear at today's hearing.  In their absence, the Adjudicator ordered them to pay the MPFA the sums of $41,790.00, $22,750.38, $10,206.00, $9,409.92 and $9,452.50 respectively, being mandatory contributions in arrears and surcharges payable.

     The amount awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA.  The court further awarded payment of $120, $350, $250, $220, $260 and $150 as costs in respect of the claims.
