Four employers fined for breaching MPFS Ordinance

    Four employers were fined a total of $100,000 at the Kwun Tong Magistracy today (January 3), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance. In the District Court, one employer was ordered to pay a total of some $150,000 for seven employees today, who were owed MPF contributions by their employer.

     In the first case, the defendant, Teletech Communication Limited was fined $10,000 after pleading guilty to an offence of failing to enrol one employee in an MPF scheme.

     In the second case, the defendant, Li Siu Man trading as Luen Bon Engineering Co., pleaded guilty to 10 counts of failing to make MPF contributions on time, after making deduction from the income of an employee between April 2004 and January 2005. The defendant was fined $6,000 for the first summons and $2,500 each for the other nine summonses, totalling $28,500.

     In the third case, the defendant, Strong Base Engineering Limited, pleaded guilty to 10 counts of failing to make MPF contributions on time for an employee between February and November 2004.  The defendant was fined $6,000 for the first summons and $2,500 each for the other nine summonses, totalling $28,500.

     In the fourth case, the defendant, Pacpo Investments Limited, pleaded guilty to 11 counts of failing to make MPF contributions on time for three employees between August and December 2004.  The defendant was fined $8,000 for the first summons and $2,500 each for the other 10 summonses, totalling $33,000.

     Meanwhile, the District Court today issued a judgement against an employer. The defendant, Super Bond Engineering & Enterprise Limited, was ordered to pay the MPFA the sum of $151,506.34, being mandatory contributions in arrears and surcharges payable to seven employees of the defendant.

     The amount awarded will be reimbursed to the employees' MPF accounts as soon as it is received by the MPFA. The court further ordered the defendant to pay $930 to the MPFA as the cost of the claim.
