Registered minor works contractor ordered by disciplinary board to have his name removed from register for 12 months

     The Registered Contractors' Disciplinary Board has completed a disciplinary inquiry and decided that a registered minor works contractor (RMWC) should be disciplined for having been convicted by the court of offences relating to minor works.

     The Board's decision and order made on August 11 were published in the Gazette today (August 26). Details are available at the following link: www.gld.gov.hk/egazette/pdf/20222634/egn202226344596.pdf.

     The Board ordered the name of the RMWC to be removed from the minor works contractors' register kept under the Buildings Ordinance (BO) for 12 months, with effect from the date of the above Gazette. Also, the RMWC shall pay about $54,000, being the costs of the Board and the Buildings Department (BD) for the disciplinary inquiry.

     The RMWC submitted certificates to the BD in April 2018 certifying the completion of minor works item 3.26, which was removal of projections from an external wall of a building at a shop at Queen's Road East, Wan Chai. Subsequently, the BD conducted an audit inspection and revealed that the works involved erection of several supporting frames for air-conditioning units under minor works item 3.27 for which the RMWC was not registered. In addition, the specified forms were not submitted within 14 days after the completion of works, contravening the relevant requirements of the Building (Minor Works) Regulation. The RMWC thus committed offences under the BO and the Building (Minor Works) Regulation and was convicted by the court.

     In view of the convictions, the BD notified the Board for consideration of disciplinary action against the RMWC under the provision of section 13(1) of the BO.

     A spokesperson for the BD reiterated that any registered contractor who contravenes the relevant provisions of the BO in carrying out minor works is not only liable to criminal prosecution, but also disciplinary action under the BO.
