Company and its director fined for Labour Tribunal award payment default

     Chi Ming Engineering Company Limited and its director were fined a total of $65,000 at Eastern Magistrates' Courts today (September 5) for defaulting on the payment of a Labour Tribunal award offence and were ordered to clear the outstanding amount of $123,000 to an employee via the court. The prosecution was launched by the Labour Department.

     The company failed to pay the awarded sum to an employee within 14 days after the specified payment date of the Labour Tribunal award, as required by the Employment Ordinance. The director was convicted for his consent, connivance or neglect in the offence.

     "The judgment would send a strong message to all companies and their directors or responsible persons that they have to ensure that an award is paid according to the terms of the award issued by the Labour Tribunal or the Minor Employment Claims Adjudication Board," a spokesman for the Labour Department said.

     "The Labour Department does not tolerate wage offences and defaulting on the payment of Labour Tribunal award offences, and spares no effort in bringing to justice directors and employers who defy the law," the spokesman added.
