Company director fined for breaching MPFS Ordinance

    A company director was fined $14,000 at the Kwun Tong Magistracy today (December 5), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.

     The defendant, Chan Kam Yin, director of Vitro Interior Design Limited, was charged with offences under section 7A(8) and section 44 of the Ordinance.  The defendant pleaded guilty to three counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between November 2003, and February and March 2004.  The defendant was fined $4,000 for the first summons and $1,500 each for the other two summonses. The defendant also pleaded guilty to three counts of offences under section 7A(2) and section 44 of failing to contribute to the relevant registered scheme from the employer's own funds within the prescribed time for the contribution periods between October 2003, and December 2003 and January 2004. The defendant was fined $4,000 for the first summons, and $1,500 each for the other two summonses. The defendant was fined totalling $14,000.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today obtained an order in the District Court for payment of outstanding MPF contributions at about $190,000 against one employer.

     The District Court today issued a judgment against an employer - Manchester Bykas Limited. The defendant was ordered to pay the MPFA the sum of $196,512.59, being mandatory contributions in arrears and surcharges payable to 10 employees of the defendant.

     The MPFA also pursued a claim in the Small Claims Tribunal for some $30,000 on behalf of an employee, who was owed MPF contributions by its employer. At the Tribunal's hearing, the defendant, Hallmark Fashions Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA the sum of $38,426.85, being mandatory contributions in arrears and surcharges payable.

     The amount awarded will be reimbursed to the employee's MPF account as soon as it is received by the MPFA. The court further awarded payment of $180 as the cost in respect of the claim.

     Hallmark Fashions Limited pleaded guilty at Kwun Tong Magistracy earlier to three counts of failing to make MPF contributions on time and was fined $10,000.
