Broadcasting Authority substantiates 3 complaints

    The following is issued on behalf of the Broadcasting Authority:

     The Broadcasting Authority (BA) has considered three complaints and found them substantiated. The first case was about the television programme "㑿籞﷿ýÿ㔄" broadcast on Blue Dream Channel of now Broadband TV on August 31, 2004 from midnight to 12.18am. The BA considered that despite the computer masking effect, some of the contents of the programme, where the depictions of sexual contact were clearly discernible, were of a hard core nature. PCCW Media Limited was strongly advised to observe more closely the relevant provisions of the Code of Practice on prohibition of the broadcast of obscene and hard core material.  

     The second and third cases were about the television programmes, "Haruka Yui 2" broadcast on CAT 86 channel of Hong Kong Cable Television Limited (HKCTV) on July 25, 2004 from 1.15pm to 2.15pm and "Ayukawa Ami" broadcast on CAT 86 channel of HKCTV on August 3, 2004 from 12.15am to 1.15am. The BA considered that despite the computer masking effect, some of the depictions of genitals, sexual contact and sexual scenes in the two programmes were still discernible and were of a hard core nature. HKCTV was strongly advised to observe more closely the relevant provisions of the Code of Practice on prohibition of obscene and hard core material with regard to the programmes "Haruka Yui 2" and "Ayukawa Ami" respectively.

     The BA also noted that from April 19 to 31, 2006, the Commissioner for Television and Entertainment Licensing dealt with 47 cases (57 complaints) under her delegated authority, of which two cases (two complaints) were classified as minor breaches, and 34 cases (36 complaints) as unsubstantiated, under section 11 of the Broadcasting Authority Ordinance; and 11 cases (19 complaints) were found to be outside section 11 of the Ordinance.
