Employer fined for breaching MPFS Ordinance

    An employer was fined $10,000 at the Kwun Tong Magistracy today (March 15), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     The defendant, Ocean Jet Development Limited (BR no.: 16765103), was convicted of an offence under section 7 of the ordinance. The defendant was fined $10,000 for failing to enrol its employee in an MPF scheme as required by the ordinance.

     Meanwhile, The Mandatory Provident Fund Schemes Authority (MPFA) today pursued two claims in the Small Claims Tribunal for some $87,000 on behalf of two employees, who were owed MPF contributions by their employers.

     At the Tribunal's hearing today, the defendants, Hin Sum Manpower Company Limited and Wong Ka Kee trading as Chung Sun Electrical Company, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $48,124.74 and  $38,777.3 respectively, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The court further awarded payments of $130 and $240 for the Tribunal cases respectively as costs in respect of the claims.

     Hin Sum Manpower Company Limited pleaded guilty at Kwun Tong Magistracy earlier to nine counts of failing to make MPF contributions on time and was fined $26,000.
