The Mandatory Provident Fund Schemes Authority (MPFA) today (February 24) obtained an order for payment of outstanding MPF contributions owed to 28 employees at around $200,000 against one employer in the District Court. The MPFA today also pursued nine claims in the Small Claims Tribunal for some $160,000 on behalf of 16 employees, who were owed MPF contributions by their employers.
The District Court today issued a judgment against one employer, A & R Engineering Company Limited. The defendant was ordered to pay the MPFA the sum of $203,442.99, being mandatory contributions in arrears and surcharges payable to 28 employees of the defendant.
At the Tribunal's hearing today, the two defendants, Tsui Chi Tsun (formerly known as Tsui Ming Kai) formerly trading as Port Management Co and Bozz Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $18,958.06 and $4,522.5, being mandatory contributions in arrears and surcharges payable.
The other seven defendants, including Gogobus Management Limited, Fine Projects Limited, Shun Tat (China-HK) Transportation Limited, Year Fortune Limited trading as Hung Fok Lau Seafood Hot-pot Restaurant, Eternity International Limited, Saiton Engineering Limited and Ryuna Japanese Restaurant Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $32,455.9, $30,897.78, $30,395.62, $29,268.23, $8,179.07, $8,079.04 and $3,675, being mandatory contribution in arrears and surcharges payable.
The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The court further awarded payments of $930 for the District Court case, $180, $80, $220, $110, $130, $410, $260, $120 and $230 for the Tribunal cases respectively as costs in respect of the claims.
