Three employers order to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (January 25) obtained an order in the District Court for payment of outstanding MPF contributions owed to employees at around $540,000 against an employer. MPFA today also pursued two claims in the Small Claims Tribunal for some $12,000 on behalf of two employees, who were owed MPF contributions by two employers.

     The District Court today issued a judgment against an employer. The defendant, Bright Charter (Hong Kong) Limited trading as Tung Lok Hin, was ordered to pay the MPFA $538,009.02, being mandatory contributions in arrears and surcharges payable to 51 employees.

     At the Tribunal's hearing today, one defendant, New Style Optical Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $7,404.06, being mandatory contributions in arrears and surcharges payable.

     The other defendant, Loyal Profit Corporation Limited trading as Uncle Fai Seafood Restaurant, did not appear at today's hearing. In its absence, the Adjudicator ordered it to pay the MPFA $5,252.87, being mandatory contributions in arrears and surcharge payable.

     The amounts awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The court further awarded payments of $930 for the District Court case, $270 and $240 for the Tribunal cases respectively as costs in respect of the claims.
