The Labour Department (LD) is inviting applications from eligible persons for appointment as approved assessors in accordance with the Minimum Wage Ordinance (MWO) (Cap. 608) and the Minimum Wage (Criteria for Approved Assessors) Notice (Cap. 608A) (the Notice).
The Statutory Minimum Wage (SMW) applies to employees with disabilities and able-bodied employees alike. Therefore, employees with disabilities are also entitled to wages not lower than the SMW rate. Under the MWO, employees with disabilities whose productivity may be impaired by their disabilities can also choose to have productivity assessment and be remunerated at a rate commensurate with their productivity. The right to invoke productivity assessment which should be conducted by approved assessors is entirely vested in the employees with disabilities.
Eligible persons may submit applications to the LD on or before February 14 for appointment as approved assessors. The Notice specifies that approved assessors should be registered occupational therapists, registered physiotherapists, registered social workers or vocational rehabilitation practitioners with the requisite years of experience in the provision of vocational rehabilitation or other services in relation to the employment of persons with disabilities. All eligible applicants are required to complete satisfactorily training arranged by the LD in order to become approved assessors. Information of approved assessors will be included in the "Register of Approved Assessors". Employees with disabilities who decide to have assessment may select and contact approved assessors from the Register to conduct assessment. The LD will disburse to an approved assessor an allowance of $2,000 per case upon the completion of productivity assessment and administrative work as required.
