Kin Ngai Scaffoldings Company Limited was fined $40,000 at Fanling Magistrates' Court today (August 13) for violation of the Construction Sites (Safety) Regulations. The prosecutions were launched by the Labour Department.
The case involved a fatal accident on June 1 last year on a construction site at Yuen Long. A worker fell to his death while erecting a bamboo scaffold at the external wall of a building.
According to Regulation 38B(1A) of the Construction Sites (Safety) Regulations, the contractor shall take adequate steps to prevent a person from falling from a height of two metres or more. Any contractor who fails to do so is liable to a maximum fine of $200,000.
In addition, according to Regulation 38AA(2) of the Construction Sites (Safety) Regulations, the contractor shall ensure that, so far as is reasonably practicable, suitable and adequate safe access to and egress from a place of work is provided and properly maintained. Any contractor who fails to do so is liable to a maximum fine of $200,000.
