Government's response to ruling of Court of Appeal

     In response to media enquiries today (December 12) on the judgment of the Court of Appeal that the relevant offence provisions under the Telecommunications Ordinance are constitutional, a spokesman for the Government said the following:

     ˇ°We welcome the judgment. The Court of Appeal has clearly ruled that that the relevant offence provisions are constitutional.  This means that unlicensed broadcasting is against the law.  Anyone engaged in such activities including establishing or maintaining a means of telecommunications without a licence, and anyone who participates in any broadcast by such means is liable to criminal prosecution.   The earlier cases will be submitted to the Magistrate for resumption of the trial against the defendants in breach of the law.ˇ±
