Ten employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (2 March) obtained five orders for payment of outstanding MPF contributions at about $1,260,000 against five employers in the District Court.  Meanwhile, the MPFA pursued five claims in the Small Claims Tribunal for some $139,000 on behalf of six employees, who were owed MPF contributions by their employers.

     The District Court today issued five judgments against five employers, namely, Polywell Engineering Limited, Wisdom Color Separation Company Limited, Tsoi Bun Kui trading as Electrodec Engineering Co., Lucky Bakery House Limited and Wong Yat Tung trading as Tung Sing Glass Company. The defendants were ordered to pay the MPFA the sums of $674,763.12, $248,468.86, $137,967.44, $132,989.41 and $82,238.52, being mandatory contributions in arrears and surcharges payable to 51, 12, 3, 99 and 4 employees of the defendants respectively.

     The Adjudicator also ordered Wisdom Color Separation Company Limited to pay the MPFA the sum of $5,000 being financial penalty imposed by the MPFA for failure to make MPF contributions for employees.

     At the Tribunal's hearing today, the defendant, Imperial Industry Company Limited, did not dispute the amounts claimed. The Adjudicator ordered it to pay the MPFA the sum of $42,953.18, being mandatory contributions in arrears and surcharges payable.

     The other four defendants, including Creator Investments Limited trading as New Choice Seafood Restaurant, Keiyo Electronic Limited, Chan Tat Kwok trading as Dragon Link Logistic (HK) Co and Tsang Ka Ho formerly trading as Milan Furniture, did not appear at today¡¯s hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $47,076.97, $42,371.49, $5,617.42 and $794.02, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for the District Court case and $170, $190, $170, $100 and $190, as the costs in respect of the Tribunal's claims.
