10 employers ordered to pay MPF

    The Mandatory Provident Fund Schemes Authority (MPFA) today (July 10) obtained two orders for payment of outstanding MPF contributions at around $400,000 against two employers in the District Court. MPFA today also pursued eight claims in the Small Claims Tribunal for some $230,000 on behalf of 19 employees, who were owed MPF contributions by their employers.

     The District Court today issued two judgments against two employers, namely, Excellence Engineering Co Ltd and FBI Design Co. Limited. The defendants were ordered to pay the MPFA the sums of $340,313.71 and $63,506.37 respectively, being mandatory contributions in arrears and surcharges payable to 13 and 6 employees of the defendants respectively.

     At the tribunal's hearing today, the two defendants, including Happywill Limited and Club House Communication Limited, did not dispute the amounts claimed. The Adjudicator ordered the employer to pay the MPFA the sums of $30,309.14 and $8,184.75, being mandatory contributions in arrears and surcharges payable.

     The other six defendants, including Tsoi Mau Hung, Kong Kwok On and Fong Chun Hing trading as Wing Lun Construction Engineering Co, Tsoi Mau Hung and Fong Chun Hing trading as Wing Lun Construction Co., Kwok Kwai Yung and Lee Lai Shueng trading as E-Fat Textile Co, Fung Chung Lok trading as Studio Paragon International, Smart-Tone Technology Logistic Service Company Limited and  Choices Limited trading as Yat Lung Garment Factory, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $49,632.8, $49,031.86, $40,227.66, $25,095, $17,638.85 and $10,081.66, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for the District Court cases and $270, $320, $210, $190, $190, $110, $110 and $110 for the Tribunal cases as costs in respect of the claims.
